im on an loa from work due to medical condition can i collect unemployment?

my dr old me i could not work any more do to a medical condition rlated to work and i nedd surgery could be out of work until next year..i cannt use any vacation time because i not an active employee and i have no payable benefits....the kicker is this is a well known company with a union and they are a selfinsured company so they can pay workers comp directly to employees, but cannot get that either. anybody have an answer

1. talk to your employer first. consider a career change rather than unemployment. use your LOA to achieve positive goals. talk to a counselor at the local community college.
2. the second you left work you should have been on sick pay or disab pay....what the heck did you do?????
3. No, this is not a lay off. You qualify for temporary disability, the same as you will qualify for after the baby is born. Your companies HR department can set this up. Disability is not workmans comp.
4. If your Doctor takes you off work due to a work related injury then it becomes a workman's comp issue whether your employer likes it or not. That means you go to your employer and ask for the workman's comp paperwork and if they refuse you get a lawyer. If you are already on a leave of absence due to medical then why haven't you filed for state disability yet? What do you think you are paying SDI taxes for? Talk to your Dr. - he can get you started on State Disability.
5. Unemployment isn't available if you aren't able to work and looking for work, so that doesn't sound like an option. Workers comp would only be available if you were hurt on the job. You could look into disability.
6. No. You can't collect unemployment if you're incapable of working. What you need, is disability coverage. If you bought it, great. If not, it's too late.
