Hypoxia and Medicine

If one has healthcare POA of a person and someone take them from the hospital without your permission?

My brother went the hospital and picked my mom up who has dementia and took her to his wife and his rest home. Mom had several small strokes there and it took them a while to find her, she suffered anoxia and had to put on a vent. She will never be the same. She was ambulatory, able to feed herself (now she has a feeding tube) she was verbal, (now non-verbal). She had a good outlook on life. Now she is deterioating very quickly. She is now in long-term skilled care and he hasn't even visited her! He is her payee and thats all he wanted. He hasn't even bought her a gown to wear! He told me if I didn't come get her clothes, he was going to set them on his porch because someone else wanted that room she slept in! What can he be taken to court for? Neglect? abandonment? Please tell me. this is my mother and he doesnt care a nything for her. He just wanted her checks so he went behind my back and got himself labeled as her power of attorney! What can I do about this?

  1. If your brother has POA for your mother, there is nothing you can do about it. In order for you brother to become her POA, she had to sign a form authorizing it. You're in a bad way. Sorry.
